These Terms of Service (“Terms”) govern the relationship between Springer Insurance (“Agency,” “we,” “us,” or “our”) and any individual or entity (“Client” or “you”) that uses our insurance agency or brokerage services.
By requesting services, submitting applications, or purchasing insurance through the Agency, you agree to these Terms.
1. Scope of Services
Springer Insurance operates as an independent insurance agency. Services may include:
- Placement of insurance coverage with authorized insurers
- Policy servicing, renewals, and endorsements
- Application assistance and administrative support
- General explanations of insurance products
The Agency acts solely as an intermediary and is not an insurance carrier.
2. No Binding Authority or Coverage Guarantee
Unless expressly authorized in writing by an insurance carrier:
- The Agency does not bind coverage
- Coverage is not effective until confirmed by the carrier
- Submission of an application or payment does not guarantee coverage
Coverage terms, acceptance, pricing, and underwriting decisions are determined solely by the insurance carrier.
3. No Legal, Tax, or Financial Advice
The Agency does not provide legal, tax, accounting, or financial advice. Information provided is general and informational only.
Clients should consult qualified professionals for advice regarding legal, tax, or financial matters.
4. Client Responsibilities
Clients agree to:
- Provide complete, accurate, and truthful information
- Notify the Agency promptly of material changes in risk
- Review all policies and documents upon receipt
- Report errors or coverage concerns immediately
Failure to provide accurate information may result in coverage denial, policy rescission, or claim denial.
5. Policy Review and Coverage Decisions
Clients are solely responsible for selecting coverage limits, deductibles, policy types, and optional endorsements.
The Agency is not responsible for gaps in coverage resulting from client decisions or declined recommendations.
6. Premiums, Fees, and Compensation
Premiums are determined by insurance carriers. The Agency may be compensated through commissions, fees (where permitted by law), or contingent arrangements.
Any agency fees will be disclosed as required by applicable law.
7. Payment, Unearned Premium, and Refunds
Premiums may be collected by the Agency as authorized by insurers or law.
If a policy is canceled, unearned premium may be refundable only in accordance with policy terms, carrier rules, and applicable law.
Refunds are subject to minimum earned premiums, carrier cancellation rules, and processing timeframes beyond the Agency’s control.
8. Cancellations and Non‑Renewals
Policies may be canceled or non‑renewed for reasons including non‑payment, underwriting decisions, misrepresentation, or eligibility changes.
The Agency is not responsible for insurer cancellation or non‑renewal decisions.
9. Claims Assistance
The Agency may assist with claims reporting as a courtesy but does not adjust or settle claims.
Claims determinations are made solely by insurance carriers.
10. No Warranties or Guarantees
All services are provided “as is” and “as available.” No warranties are made regarding coverage sufficiency, claims outcomes, or insurer solvency.
11. Limitation of Liability
To the maximum extent permitted by law, the Agency’s liability shall not exceed the commissions or fees received for the applicable policy period.
The Agency shall not be liable for indirect, consequential, or special damages.
12. Errors & Omissions Coverage
The Agency maintains Errors & Omissions insurance coverage in accordance with industry standards.
13. Intellectual Property
All Agency materials are proprietary and may not be reproduced or distributed without prior written consent.
14. Electronic Communications
Clients consent to receive communications and documents electronically, including email delivery and electronic signatures where permitted by law.
15. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Virginia. Any legal action shall be brought in a court of competent jurisdiction in that state.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
17. Modifications
The Agency reserves the right to modify these Terms at any time. Updated Terms apply to future transactions and ongoing relationships unless prohibited by law.
